1. Acceptance of Terms

By creating an account, accessing, or using AutoPod (https://autopod.tech), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and AutoPod.

You must be at least 13 years old to use this Service. If you are under 18, you must have permission from a parent or guardian to use the Service.

2. Service Description

AutoPod is an AI-powered educational podcast generation platform that allows users to:

• Generate podcast scripts from topics or website URLs using AI (OpenAI GPT-4)
• Convert text to high-quality speech using AI voice synthesis (OpenAI TTS)
• Create, manage, and store podcast episodes
• Generate RSS 2.0 feeds for podcast distribution
• Schedule automated daily episode creation
• Download and share generated podcast episodes

The Service is provided on an "as-is" and "as-available" basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. User Accounts and Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your password
• Accept all responsibility for activities that occur under your account
• Notify us immediately at support@autopod.tech of any unauthorized account access
• Not share your account credentials with others
• Not create accounts using false information or impersonate others

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Subscription Plans and Billing

Free Plan

• 3 episodes total (lifetime limit)

• No credit card required

Pro Plan - $19/month

• Unlimited episode generation
• Daily automation scheduling
• Priority processing
• Advanced features and future updates
• All features from Free Plan

Billing Terms

• Pro subscriptions are billed monthly in advance via Stripe
• Subscriptions auto-renew unless cancelled before the renewal date
• You can cancel anytime from your account dashboard or billing portal
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months, except as required by law
• We reserve the right to change pricing with 30 days notice
• All fees are in USD and exclude applicable taxes

5. Acceptable Use Policy

You agree NOT to use the Service to create, upload, or distribute content that:

• Is illegal, harmful, threatening, abusive, harassing, or discriminatory
• Infringes on intellectual property rights, trademarks, or copyrights
• Contains hate speech, violence, or promotes illegal activities
• Is pornographic, sexually explicit, or inappropriate for general audiences
• Contains malware, viruses, or malicious code
• Impersonates any person or entity, or misrepresents affiliation
• Violates privacy rights or discloses personal information without consent
• Constitutes spam, commercial advertising, or unsolicited messages
• Attempts to gain unauthorized access to our systems or other users' accounts
• Interferes with or disrupts the Service or servers
• Uses automated tools (bots, scrapers) without written permission
• Violates OpenAI's usage policies or terms of service

Violation of this Acceptable Use Policy may result in immediate account termination and legal action.

6. Intellectual Property and Content Ownership

Your Content

You retain all ownership rights to content you create using AutoPod (podcast episodes, scripts, audio files). However, by using the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to:

• Store, process, and host your content to provide the Service
• Use AI systems (OpenAI) to generate scripts and audio
• Display your content in your account dashboard and RSS feeds
• Create backups for data protection purposes

AutoPod's Intellectual Property

The Service, including its design, code, features, branding, and underlying technology, is owned by AutoPod and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

Third-Party Content

If you generate content from third-party URLs, you are responsible for ensuring you have the right to use that content. We are not responsible for copyright infringement resulting from your use of third-party content.

7. AI-Generated Content Disclaimer

Content generated by AutoPod uses AI technology (OpenAI GPT-4 and TTS). You acknowledge that:

• AI-generated content may contain errors, inaccuracies, or biases
• You are responsible for reviewing and verifying content before distribution
• We do not guarantee factual accuracy of AI-generated scripts
• AI models may occasionally produce inappropriate or unexpected outputs
• You should not rely solely on AI-generated content for critical decisions
• Content quality may vary based on input quality and AI model capabilities

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED
• WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE LAST 12 MONTHS OR $100, WHICHEVER IS GREATER
• WE ARE NOT RESPONSIBLE FOR DATA LOSS, SERVICE INTERRUPTIONS, OR THIRD-PARTY ACTIONS
• WE DO NOT GUARANTEE UNINTERRUPTED, SECURE, OR ERROR-FREE SERVICE
• YOU USE THE SERVICE AT YOUR OWN RISK

9. Indemnification

You agree to indemnify, defend, and hold harmless AutoPod, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of third parties
• Content you create or distribute using the Service
• Your breach of any applicable laws or regulations

10. Termination and Suspension

Termination by You

You may cancel your account at any time through your account settings or by contacting support@autopod.tech. Upon cancellation:

• Your subscription will remain active until the end of the billing period
• You will retain access to your content until account deletion
• You can download your content before deletion

Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms or our Acceptable Use Policy
• Your account is involved in fraudulent or illegal activity
• Your payment method fails or subscription is unpaid
• We are required to do so by law
• We discontinue the Service

Effect of Termination

Upon termination, your right to access the Service ceases immediately. We may delete your content after 30 days. Provisions regarding intellectual property, liability, and dispute resolution survive termination.

11. Dispute Resolution and Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall first be resolved through good-faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You waive any right to participate in class action lawsuits or class-wide arbitration.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or prominent notice on the Service at least 30 days before changes take effect. Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree with changes, you must stop using the Service and cancel your account.

13. Miscellaneous

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement
• Severability: If any provision is invalid, the rest remains enforceable
• Waiver: Failure to enforce any right does not constitute a waiver
• Assignment: You may not assign these Terms; we may assign without restriction
• Force Majeure: We are not liable for delays due to circumstances beyond our control
• No Agency: These Terms do not create partnership, employment, or agency relationship
